• Bonus: Any financial stakes in a game as per the Game Rules.

• Deposit: The segment of a user’s account where deposited funds are credited.
• Deposit Segment: The portion of a user's YesNo Game Account where deposited money is stored.
• Discounts: Includes bonuses, instant cash, extra cash, or incentives provided by the company as part of its pricing strategy.
• Game(s): Skill-based opinion trading formats available on the website, including various versions and structures.
• Commission: A fee charged by the company for using its products and services, deducted as per the commission communicated to users.
• Refund: Reversal of specific amounts paid by a user (such as buy-ins, service fees) back to their YesNo Account.
• Restricted States: Indian states where online gaming, including poker, is prohibited under applicable laws.
• Terms: Refers to these Terms of Service of YesNo Game.
• Website: The YesNo Game site and its related mobile applications.
• Withdrawable Balance: The amount in the Withdrawable Segment of a user’s account.
• Withdrawal: The process of transferring all or part of the Withdrawable Balance to a user’s linked Bank Account, as per their request.
• Withdrawal Request: A user’s request to withdraw funds from their account.
• Withdrawable Segment: The section of a user’s YesNo Account where winnings from cash games are credited after deductions such as service fees.

YesNo Game Services

• YesNo Game reserves the right to modify these Terms and Conditions and Game Rules at any time. Updates will be posted on the YesNo Game site, and continued use of the platform will indicate acceptance of such changes.
• If you do not accept the modified terms, you may use the available options to indicate non-acceptance. Failure to do so within the specified timeframe will be considered acceptance of the updated terms.

User Registration

• Users can browse the YesNo Game site without registration. However, to participate in games, registration is required.
• During registration, users must:
  • Provide accurate, complete, and up-to-date information.
  • Maintain and update their details as necessary.
• Users must select a username and are solely responsible for maintaining its confidentiality.
• YesNo Game acts as a data repository and does not guarantee the accuracy or legal validity of user-submitted information.
• If there is suspicion of misuse, false information, or unauthorized account activity, YesNo Game reserves the right to suspend, terminate, or restrict access to the account.
• Users must immediately report unauthorized account access via support@yesno.game . YesNo Game is not liable for losses due to unauthorized account access.
• If a Commission has been charged, refunds will only be processed in cases of account suspension due to company error. No refunds will be issued if the suspension is due to user misconduct, policy violations, or external circumstances beyond our control.

KYC Verification

• Users must complete Know Your Customer (KYC) verification in the following cases:
  • When requesting a withdrawal.
  • If suspected of violating company policies.
  • If exceeding certain deposit thresholds.
  • At the discretion of YesNo Game.
• The KYC process requires users to submit valid documents for identity and address verification, tax identification, and bank details. Acceptable documents include:

• Providing false or misleading information will result in liability for any damages or consequences arising from such actions.

Registration and Participants

YesNo Game tournaments and contests are exclusively open to individuals residing in India who are at least 18 years old. Employees of YesNo Game, their affiliates, subsidiaries, family members, agents, sponsors, and any other associated individuals are not eligible to participate or win prizes. By participating in any game on the YesNo Game platform, users confirm that all submitted information is accurate and complete, and they may be required to provide proof of age. YesNo Game has the sole discretion to disqualify any user deemed ineligible. To register, users must provide valid details, including their full name, username, email address, state of residence, and date of birth.

Use of the YesNo Game Site

All content on the YesNo Game platform, including text, graphics, logos, software, and other materials, is owned by YesNo Game or its vendors and suppliers. Users may only access and use the platform for personal, non-commercial purposes. Any reproduction, modification, or distribution of materials without prior written permission is strictly prohibited. Legality

The YesNo Game platform operates under Indian laws, and participation is restricted to users located in India, excluding certain states (Tamil Nadu, Nagaland, Sikkim, Assam, Andhra Pradesh, Telangana, and Odisha). Residents of these excluded states are not eligible to register or participate in paid contests. If a user from a restricted state is found concealing their location, their account may be blocked, reset, or deleted, and any winnings forfeited. Changes in state laws may alter eligibility, but past winnings for previously ineligible users will not be reinstated.

YesNo Game is not liable for any legal restrictions affecting a user’s participation. The platform does not guarantee the legality of participation and disclaims responsibility for any legal consequences users may face.

International Users

YesNo Game is intended for use within India and does not guarantee availability outside the country. Users accessing the platform from outside India do so at their own risk and must comply with local laws. User Conduct

Users must also provide required identification documents when requested and agree to receive communications from YesNo Game. Platform Fee

Commission charges may include, but are not limited to:

Taxes Payable

All winnings are subject to tax deduction at source (TDS) under the Income Tax Act, 1961. The Government of India mandates a 30% TDS on net winnings as per Section 194B. This deduction will occur at the time of withdrawal if applicable. Additionally, on March 31 each year, a 30% TDS will be applied to any outstanding net winnings in the user's wallet.

If the Government revises the tax rate in the future, YesNo Game will deduct TDS accordingly.

Winners are also responsible for any other applicable taxes, such as income tax or gift tax, on their pool money.

Goods and Services Tax (GST) on Deposits

Starting October 1, 2023, a 28% GST applies to all deposits for online gaming in India, as per amendments to the Central Goods and Services Tax (CGST) laws.

To enhance the user experience, YesNo Game currently covers the GST cost on deposits, ensuring that the amount you deposit remains unaffected. However, this policy is subject to change without prior notice, so users are advised to review the terms periodically.

Privacy Policy

By using YesNo Game, you acknowledge and agree to the Privacy Policy, which is available at https://yesno.game/privacypolicy. This policy governs all entries to games and services on the platform.

Intellectual Property Rights

All content, including text, images, videos, trademarks, and logos, on YesNo Game's website belongs to YesNo Game or its licensors. Users may not copy, modify, or distribute this content without prior written consent. Any unauthorized use of these materials is strictly prohibited and may lead to legal action.

Governing Law and Jurisdiction

All legal matters related to YesNo Game fall under the jurisdiction of Delhi courts. Disputes will be governed by Indian law.

Dispute Resolution

If a dispute arises, parties must first attempt resolution through discussions. If unresolved within 15 days, arbitration will be conducted in Delhi under the Arbitration and Conciliation Act, 1996.

Arbitration will be conducted in English, and the arbitrator may issue enforceable orders, including specific performance measures. YesNo Game may seek legal relief before or during arbitration.

User Representations and Warranties

Users acknowledge that:

• They use YesNo Game at their own risk.
• The platform may experience delays, and YesNo Game is not responsible for network/system issues.
• YesNo Game does not guarantee uninterrupted, error-free service.

Users are solely responsible for damages resulting from their use of the platform.

Breach and Consequences

If a user breaches these terms, YesNo Game may:

• Suspend or terminate their account
• Forfeit remaining account balance
• Take legal action to recover damages
• Restrict access to future games/tournaments
• Report violations to relevant authorities

Decisions taken by YesNo Game in such cases are final.

Termination

YesNo Game reserves the right to suspend or terminate a user's account at any time without notice. Upon termination, users lose access to the platform, but their obligations and YesNo Game’s rights remain in effect.

Disclaimers

YesNo Game strives to provide an error-free platform but does not guarantee that:

• The platform will meet user expectations
• Services will be uninterrupted or free of errors
• Results will be accurate and reliable

Errors in winner determination or payment transfers may be corrected. Users waive any claims related to service suspension, contest cancellations, or unforeseen interruptions.

Force Majeure

YesNo Game is not liable for failures caused by uncontrollable events such as natural disasters, strikes, government actions, or technical disruptions. In such cases, services may be suspended until further notice.

Entire Agreement

These Terms and Conditions, along with the Privacy Policy, constitute the complete agreement between users and YesNo Game. If any provision is deemed unlawful or unenforceable, the remaining terms will still apply.

Relationship

None of the provisions outlined in the Terms and Conditions shall be interpreted as establishing a partnership or agency relationship between you and YesNo Game. As a result, you do not have any authority to legally bind or represent YesNo Game in any manner.

Additionally, if you are registering on the YesNo Game platform as a business entity, you confirm and represent that you possess the necessary authority to bind that business entity to the terms of this Agreement.

TDS (Tax Deducted at Source)

In accordance with the amendment to Section 194B of the Income Tax Act, which was proposed during the Budget Session of 2023, all online gaming intermediaries are required to deduct tax at a rate of 30% on users’ net winnings earned from participating in real-money online games.

These regulations have been in effect starting from the financial year 2023-24.

The tax deduction at source (TDS) will take place at the time of withdrawal of the winnings. It is important to note that the TDS applies only to net winnings and not to the deposits made by users.

Additionally, on March 31 each year, a 30% TDS will be applied to any outstanding net winnings in the user's wallet.

Participation on YesNo Platform

As part of its services, YesNo will provide users with questions related to the probability of a specified future event occurring. This includes data and information gathered from publicly available sources, as well as the ability for users to contribute their own opinions and insights on these events.

Based on various factors such as the likelihood of an event, the timeframe of occurrence, the number of bids placed, and other considerations determined solely by YesNo, users may be permitted to modify their bids and/or place multiple bids on a particular event.

The YesNo platform will make its best efforts to match a user’s bid with a complementary bid from another user. Once a match is made, neither participant will be able to withdraw their bid. The settlement of bids will be determined by the actual occurrence and outcome of the event in question. If no complementary bid is available before the event occurs, the bid amount will be refunded to the user.

YesNo reserves the right to cancel specific questions, adjust deadlines for bidding, or make other modifications in situations beyond its reasonable control. Users will be informed of such changes through notifications via email, SMS, WhatsApp, or other communication channels.

Certain events may have unique bidding rules, which will be communicated to users before they place their bids. These rules will serve as additional terms unless explicitly stated otherwise.

To place a bid, users must pay an amount that reflects the

probability of the event occurring. A bid is considered successful if the predicted parameters of the event are met. Conversely, if the parameters are not met, the bid will be unsuccessful.

Users acknowledge that participation on the YesNo platform and placing bids on future events is based on their independent analysis. While YesNo provides publicly available data on the platform, users are encouraged to conduct their own research and make well-informed decisions before placing a bid.

To participate, users must add funds to their YesNo Account. The platform may impose limits on deposits or account balances at its discretion. Any winnings or losses will be credited or debited accordingly from the user’s YesNo Account.
